				<content:encoded><![CDATA[<p><em>“America’s economy is poised to grow and expand. And the last thing it needs is another manufactured crisis – such as a government shutdown – to derail its progress.”</em></p>
<p><strong>Washington, D.C.</strong> – <em>Senate Majority Leader Harry Reid spoke on the Senate floor today regarding on Nevada judicial nominee Andrew Gordon, on a continuing resolution to fund the government through the end of the fiscal year and on the 2014 retirement of Senator Carl Levin. Below are his remarks as prepared for delivery:</em></p>
<p>This evening, the Senate will vote on two judicial nominations: Richard Gary Taranto, of Maryland, to be United States Circuit Judge for the Federal Circuit and Andrew Patrick Gordon, of Nevada, to be United States District Judge for the District of Nevada.</p>
<p>Andrew Gordon, of Las Vegas, graduated from Harvard Law School in 1987 after receiving his Bachelor’s degree from Claremont McKenna College. He is a partner with the law firm of McDonald Carano Wilson, where he has been a partner since 1997. Mr. Gordon handles complex commercial disputes. He also focuses on alternative conflict resolution, and regularly serves as an arbitrator and mediator.</p>
<p>Mr. Gordon also performs a variety of pro bono work, including handling adoption proceedings and representation of an inmate on death row in a habeas corpus proceeding. He has consistently been named as one of the Best Lawyers in America. I have no doubt he will serve the court well, and I look forward to his confirmation.</p>
<p>This week the Senate will also take up legislation to fund the government through the end of the fiscal year. I applaud Appropriations Committee Chairman Mikulski and Ranking Member Shelby for working diligently through the weekend to reach a bipartisan agreement on a path forward.</p>
<p>Senator Mikulski and Senator Shelby, two seasoned veterans, have worked hard to get this legislation ready. They are two of our most senior members. They are also two of our most respected members.</p>
<p>The measure passed last week by the House of Representatives is not perfect. Senators will wish to offer amendments. And we are working out a process to consider those amendments.</p>
<p>This week will offer another opportunity for the United States Senate to return to the regular order – an opportunity for this body to legislate through cooperation and compromise. It will also be a test of the Senate’s good will.</p>
<p>America’s economy is poised to grow and expand. And the last thing it needs is another manufactured crisis – such as a government shutdown – to derail its progress.</p>
<p><strong>Senator Carl Levin Announces Retirement</strong></p>
<p>For some public servants, the political fire is lit by their first trip to Washington, D.C. or by a moving and memorable party convention speech. For others, a history of military service leads to a career in public service. For still others, a single issue – such as a proposed freeway through a vibrant community – propels them into politics. But for Senator Carl Levin, serving Michigan families is something of a family business.</p>
<p>Senator Levin’s father, Saul, served on the Michigan Corrections Commission. His uncle, Theodore Levin, was the chief judge for the U.S. District Court for Eastern Michigan. And I was elected to Congress in 1982, the same year as Carl’s brother, Sander Levin, the ranking member of the House Ways and Means Committee.</p>
<p>The first time I met Senator Levin, I mentioned that I had come to the House of Representatives with his brother. And Carl said, yes, Sandy is my brother, but he’s also my best friend. That’s something I’ve never forgotten. These two brothers, natives of Detroit, have done so much for the state of Michigan.</p>
<p>Carl Levin is a truly outstanding Senator and an even better man. The senior Senator from Michigan is the longest serving Senator in his state’s history. But he dedicated his life to serving residents of Michigan long before he was elected to the United States Senate.</p>
<p>Senator Levin served as general counsel of the Michigan Civil Rights Commission and as assistant attorney general for the state of Michigan. And he served two terms in the Detroit City Council, including one term as council president.</p>
<p>As a Senator, Carl Levin has consistently stood up for Michigan families – whether that meant supporting the auto industry, protecting Lake Michigan, holding credit card companies accountable or securing funding for sons and daughters serving in the United States military.</p>
<p>As Chairman of the Senate Armed Services Committee, Carl Levin is one of the nation’s most respected voices on national security issues and most powerful advocates for the men and women of the United States Armed Forces.</p>
<p>And as chairman of the Senate Permanent Subcommittee on Investigations, he has sought the truth on behalf of American families time and time again. He led investigations of the 2008 financial crisis, abusive credit card practices and the Enron collapse.</p>
<p>Carl’s dedication to the United States Senate is matched only by his dedication to his own family. He has been married to his wife, Barbara, for more than 50 years. They have three daughters and six grandchildren. And I’m sure Carl is looking forward to spending more time with those grandchildren.</p>
<p>But when he retires in two years, the Unites States Senate will be sorry to lose this powerful voice for military service members and Michigan families.</p>

				<content:encoded><![CDATA[<p><strong>Washington, D.C.</strong> – <em>Nevada Senator Harry Reid spoke on the Senate floor today regarding the nomination of Miranda Du to the U.S. District Court, District of Nevada. Below are his remarks as prepared for delivery:</em></p>
<p>Today the Senate will consider the nomination of Miranda Du to the U.S. District Court, District of Nevada, in Las Vegas.</p>
<p>I was pleased to recommend the nomination of such an experienced litigator and proud Nevadan.</p>
<p>Ms. Du has an enormous love for the state of Nevada, and a tremendous dedication to public service.</p>
<p>She also has an inspiring personal story that proves the American Dream is alive and well.</p>
<p>Although 9 percent of Nevada’s population is Asian-Pacific American, if confirmed Ms. Du will be the first Asian-American federal judge in the history of the state.</p>
<p>Ms. Du left Vietnam with her family by boat when she was just eight years old.</p>
<p>She lived in refugee camps in Malaysia before she came to America with her family when she was almost 10. </p>
<p>She didn’t speak English when she enrolled in an American school for the first time. But even as a third-grader she was quick to learn, and picked up the language right away.</p>
<p>Although her family initially lived in Alabama, where her father worked on a dairy farm, Du eventually moved to California.</p>
<p>There she continued to indulge her love of learning. She received her Bachelor’s degree in history and economics from the University of California, Davis and her law degree from UC Berkley.</p>
<p>It was after law school that she moved to Nevada. She joined McDonald Carano Wilson, a very well-respected law firm in my home state, and made partner in 2002.</p>
<p>Ms. Du is currently the chairwoman of her firm’s Employment &#038; Labor Law Practice Group.</p>
<p>She specializes in complex civil litigation and employment law. </p>
<p>And she has appeared before federal and state courts in all phases of litigation, including appeals before the Nevada Supreme Court and the Ninth Circuit Court of Appeals.</p>
<p>Ms. Du has the support of a bipartisan coalition of Nevada officials, including the governor, the lieutenant governor and the mayor of Reno – all Republicans.</p>
<p>Republican Governor Brian Sandoval wrote the Judiciary Committee to say Du “has exhibited great character and is well respected in the legal community.”  He gave her his full support.</p>
<p>Republican Lieutenant Governor Brian Krolicki called Ms. Du “intelligent, inquisitive, reliable and dedicated.”</p>
<p>And the Republican Mayor of Reno, Robert Cashell, said Du “will be a great addition to our federal bench.”</p>
<p>In addition to being an experienced litigator, Ms. Du is also an outstanding citizen. She is very involved in the Northern Nevada community.</p>
<p>She currently serves on the Nevada Commission on Economic Development and the board of directors of the Nevada Women’s Fund, a group dedicated to strengthening the Nevada community by empowering women.</p>
<p>She has also served as a court-appointed special advocate representing abused and neglected children and mentored high school students in Reno.</p>
<p>She is a fine example for those students. And I’m confident she’ll make an outstanding federal judge.</p>

<p>“Senate Republicans today sent the sad message that political gamesmanship is more important than a judicial nominee’s qualifications. Caitlin Joan Halligan is a qualified candidate with bipartisan support from colleagues who call her a brilliant legal mind.</p>
<p>“I am concerned that today the Senate is backing away from the 2005 agreement that the minority would only block judicial nominees in extraordinary circumstances. Since Ms. Halligan’s nomination clearly does not meet that standard, Republicans today lowered the bar for filibustering judicial nominees.</p>
<p>“I am disappointed that Republicans blocked a talented, experienced nominee for no other reason than to please a few ideological extremists. If this truly exceptional candidate isn’t qualified to be a judge in the United States of America, it is hard to imagine who Republicans would find acceptable.”</p>

				<content:encoded><![CDATA[<p><strong>Washington, D.C.–</strong><em>Nevada Senator Harry Reid made the following remarks today on the Senate floor prior to a vote to invoke cloture on the nomination of Goodwin Liu to the U.S. Court of Appeals for the Ninth Circuit. Below are his remarks as prepared for delivery:</em></p>
<p>“Two days ago I came to the floor to talk about the nomination of Goodwin Liu – an extremely well-qualified, fair-minded and widely respected legal scholar.  The President has nominated him to serve his country on the U.S. Court of Appeals for the Ninth Circuit.</p>
<p>“All week, this body has heard speeches about Mr. Liu’s merits, so I will repeat them only briefly.  He was a Rhodes Scholar and clerked on the Supreme Court.  He served as an associate dean at the California Berkley School of Law, and is still a professor there.  He has done a lot of pro bono work, and even helped launch AmeriCorps.  On top of all that, he’s lived the American Dream: he is the highly successful son of immigrants.</p>
<p>“His integrity has been praised by Democrats, and praised by Republicans – not just one or two, but by many.  Former Congressman Bob Barr commended Liu’s commitment to the Constitution.  One of President Bush’s former lawyers said Liu falls well within the mainstream.  Even Ken Starr – the Whitewater special prosecutor – endorsed this man who served in the Clinton Administration.</p>
<p>“The record is clear.  Any claim that Goodwin Liu is anything but deserving of our confirmation are simply inaccurate.  But I recognize that every Senator has the right to vote how he or she chooses.</p>
<p>“It is worth noting, however, that the vote before us now is not a vote to confirm him – it is a vote on whether he deserves an up-or-down vote.  And there is no question that he does.</p>
<p>“A simple up-or-down vote is hardly a controversial request.  This is not only my view, or the view of my fellow Democrats.  It is the view of my Republican friends, as well.</p>
<p>“In a 2004 law review article, one of our Republican colleagues – the junior Senator from Texas, a longtime justice on the Texas Supreme Court – wrote the following:</p>
<p>“‘Wasteful and unnecessary delay in the process of selecting judges hurts our justice system and harms all Americans.  It is intolerable no matter who occupies the White House and no matter which party is the majority party in the Senate. &#8230; Filibusters are by far the most virulent form of delay imaginable.’</p>
<p>“The junior Senator from Texas is in the chamber today.  We will see if he still feels this way, or, if he will – in his own words – hurt our justice system and harm all Americans with intolerable, virulent delays.  We will carefully be watching how he votes.</p>
<p>“We will also carefully be watching another Republican Senator – the senior Senator from Tennessee – who said this in 2005:</p>
<p>“‘I pledged, then and there, I would never filibuster any President’s judicial nominee, period.  I might vote against them, but I will always see they came to a vote.’</p>
<p>“The senior Senator from Tennessee is here today, too.  ‘Never’ is as unambiguous as it gets.  We will be watching to see if he upholds his public pledge.</p>
<p>“A third Republican Senator – the junior Senator from Georgia – said this, also in 2005:</p>
<p>“‘I will vote to support a vote, up or down, on every nominee.  Understanding that, were I in the minority party and the issues reversed, I would take exactly the same position because this document, our Constitution, does not equivocate.’</p>
<p>“The junior Senator from Georgia will be voting this afternoon.  Now, as he predicted, he is in the minority party, and the issue is reversed.  We will see if, as he promised, he will take the same position, or if he will equivocate.</p>
<p>“And here’s a fourth.  Four years ago, another Republican Senator – the senior Senator from Utah and former chairman of the Senate Judiciary Committee – said this, on this very floor:</p>
<p>“‘We may not use our role of advise and consent to undermine the President’s authority to appoint judges. … It is wrong to use the filibuster to defeat judicial nominees who have majority support, who would be confirmed if only we could vote up or down.  That is why I have never voted against cloture on a judicial nomination.’</p>
<p>“Yet another pledge never to vote against cloture on a judicial nomination.  That is precisely the vote before us now.  We will be watching to see if the senior Senator from Utah follows his own counsel, or if he, in his own judgment, undermines the authority of the President of the United States.</p>
<p>“These pledges were made publicly and plainly.  In a court of law, they would be considered pretty clear evidence.  It doesn’t take the great legal mind of a Goodwin Liu to recognize that.</p>
<p>“We’ve heard the promises.  Now we’ll hear the votes.  I ask for the yeas and nays.”</p>

<p><strong>Washington, D.C.–</strong><em>Nevada Senator Harry Reid made the following remarks today on the Senate floor regarding the nomination of Goodwin Liu to the Ninth Circuit U.S. Court of Appeals. Below are his remarks as prepared for delivery:</em></p>
<p>“Several years ago we faced a confirmation crisis in the Senate.  The majority at the time, the Republicans, were frustrated with the inefficient way the Senate was performing our Constitutional duty of confirming the President’s nominees.</p>
<p>“Many of my colleagues on the other side of the aisle passionately argued that all judicial nominees deserve an up-or-down vote on the Senate floor.</p>
<p>“In their frustration, they threatened to dramatically change the purpose of the Senate and the minority protections for which it was designed.</p>
<p>“That would have, in a manner of speaking, blown up this institution.  That’s why it was known as the nuclear option.</p>
<p>“In the heat of this battle, several courageous senators agreed to a standard that would preserve the traditions of the United States Senate.  They ensured the Senate could still provide the President its advice and consent, as the Constitution requires.</p>
<p>“The agreement was significant, but simple.  It was this: except in extraordinary circumstances, those nominated to be federal judges would get an up-or-down vote.  The minority would not stand in the way of that vote.  The agreement was grounded in common sense.</p>
<p>“So far, in most cases, both sides have generally upheld that agreement.  The nomination before us, however, is not one of those cases.</p>
<p>“Goodwin Liu is an extremely well-qualified public servant and impressive legal scholar.  He was a Rhodes Scholar and clerked on the Supreme Court.  He served as an associate dean at the California Berkley School of Law, and is still a professor there.</p>
<p>“He has done a lot of pro bono work, and even helped launch AmeriCorps.  On top of all that, he’s lived the American Dream: he is the highly successful son of immigrants.</p>
<p>“I think President Obama was wise to appoint him to the Ninth Circuit.  So do a lot of Democrats – and so do a lot of Republicans.</p>
<p>“Ken Starr, the former Whitewater special prosecutor, called Liu, who served in the Clinton Administration, ‘a person of great intellect, accomplishment and integrity.’</p>
<p>“Former Congressman Bob Barr, a very conservative former federal prosecutor, also reviewed Liu’s writings.  He came away impressed with, as he said, ‘his commitment to the Constitution and to a fair criminal justice system.’</p>
<p>“And one of President Bush’s former White House lawyers said Liu’s views ‘fall well within the legal mainstream.’</p>
<p>“I could go on and on with more quotes from lawyers and legislators on the right, as well as on the left and in the center.  But you get the picture.</p>
<p>“Everyone agrees that Goodwin Liu’s nomination is far from the ‘extraordinary circumstance’ that would warrant a filibuster.  The only extraordinary things about Liu are his experience, accomplishments and integrity.</p>
<p>“I think he should be confirmed unanimously.  At the very least, he undoubtedly deserves an up-or-down vote.</p>
<p>“But Senate Republicans have already forgotten the lessons of the nuclear option.  Today, they are threatening to block this highly qualified nominee from confirmation.</p>
<p>“Vacancies on the federal bench delay justice for citizens seeking the help of our judicial system.  And it isn’t fair to leave in limbo well-qualified nominees.</p>
<p>“So I am forced now to file cloture in order to ensure Goodwin Liu gets the vote he deserves.  It’s regrettable that it has come to this.</p>
<p>“As I file cloture, I remind my Republican colleagues once again that public servants are not political pawns.  Goodwin Liu has dedicated his life to justice and fairness.  As we consider his nomination, we owe someone of his caliber those same considerations.”</p>

This means justice and fairness is delayed-and often denied- for those in need, from working mothers seeking timely compensation for their employment discrimination claims to communities  hoping for swift injunction of corporate environmental polluters to small business owners seeking protection from unfair and anti-competitive practices.</p>
<p><strong>The Department Of Justice&#8217;s Office Of Legal Policy Estimates That One-Half Of The Federal Bench Will Be Empty Within 10 Years If Confirmation Rates Do Not Improve.</strong>With each new  vacancy, more and more Americans will wait years for the most basic opportunity to seek justice. Even today, the average civil litigant must wait nearly two years for a jury trial, and this wait  grows even longer if their case is appealed.[Center for American Progress, <a href="http://www.americanprogress.org/issues/2011/01/roberts_state_of_judiciary.html">1/3/11</a>]</p>
<p><strong>Litigants Are Being Forced To Wait Months And Years Before Their Cases Are Heard.</strong> In 2009, for civil litigants with trials, the average median time from filing to trial was  over 2 years (25.3 months). As judicial vacancies have been rising, so too have the delays for litigants.  [Administration Office of the U.S. Courts, Judicial Caseload Profile, <a href="http://www.uscourts.gov/cgi-bin/cmsd2009.pl" target="_blank">2009</a>]</p>

<li> <strong>Columnist: Americans “Ought To Be Livid” By Long Delays For A Fair Trial.</strong> One columnist recently wrote of the judicial vacancy crisis, “Those who ought to be   livid are ordinary citizens for whom justice delayed is indeed justice denied. Criminal defendants are guaranteed a speedy trial, but long lines of civil cases waiting for a trial date only get   longer” [Seattle Times, <a href="http://seattletimes.nwsource.com/html/editorialsopinion/2013041687_lance01.html">9/30/10</a>]</li>

<p><strong>Federal Court Caseloads Are Growing While Judicial Vacancies Persist.</strong> “In 2010, nearly all major areas of the federal judiciary had larger caseloads. Filings of bankruptcy  petitions climbed 14% to nearly 1.6 million. Filings in the U.S. district courts grew 2% to 361,323 in response to a 2% increase in civil case filings (totaling 282,895) and criminal case filings  (totaling 78,428)… Civil filings in the U.S. district courts rose 2%, increasing by 6,498 cases to 282,895… Filings of petitions for bankruptcy totaled 1,596,355, a 14% increase over  the previous year’s filings and the highest number received since 2005.” [2010 Year-End Report on the Federal Judiciary, <a href="http://www.supremecourt.gov/publicinfo/year-end/2010year-endreport.pdf">12/31/10</a>]</p>
<p><strong>In 111<sup>th</sup> Congress, Average Circuit Court Nominee Waiting 163 Days for Consideration.</strong> In the last Congress, the Senate&#8217;s average consideration of a district court  judge took 104 days, while the average circuit court nominee took 163 days. [People for the American Way, <a href="http://www.pfaw.org/media-center/publications/editorial-memorandum-judicial-nominees-and-the-state-of-the-union">1/25/11</a>]</p>
<p><strong>USA TODAY: Judicial Delays Impact Businesses, Environmental Disputes.</strong> In 2010, USA Today reported, “There are consequences to the judicial delays. The overwhelming majority  of federal civil and criminal cases end in lower courts and never reach the Supreme Court. That means judges at these trial and appeals court levels shape much of the nation&#8217;s law &#8212; from  business concerns to environmental disputes to gay rights.” [USA Today, 6/16/10]</p>
<p><strong>“If You Can’t Get Into a Courtroom… Justice Suffers.”</strong> “It stands to reason that if you can&#8217;t get into a courtroom, if the docket is too packed  for your case to be heard promptly, or if the judge lacks sufficient time to address the issues raised, justice suffers. This will directly affect thousands of ordinary Americans—plaintiffs  and defendants—whose liberty, safety, or job may be at stake and for whom justice may arrive too late, if at all. <p><strong><em><span style="text-decoration: underline;">Judges and Officials from Both Parties Recognize the Impact of the Vacancy Crisis</span></em></strong></p>
<p><strong>GOP Judges: Senate Must Fill Vacancies To Help Deal With Immigration, Drug &amp; Bankruptcy Cases.</strong> In November 2010, seven Republican-appointed federal judges from the largest  federal circuit in the country, representing 9 western states, signed a letter urging the Senate to take action on judicial vacancies. They wrote that their case-load “is heavily impacted by  increased immigration enforcement, drug interdiction activities, prison litigation, bankruptcy and environmental cases… In order to do our work, and serve the public as Congress expects us  to serve it, we need the resources to carry out our mission. While there are many areas of serious need, we write today to emphasize our desperate need for judges.” [U.S. Court of Appeals for  the 9<sup>th</sup> Circuit Letter, 11/15/10]</p>
<p><strong>Chief Justice John Roberts: Judicial Vacancies Create “Acute Difficulties.”</strong> In his 2010 year-end report, Supreme Court Chief Justice John Roberts wrote that the problem  of judicial vacancies “has created acute difficulties for some judicial districts. Sitting judges in those districts have been burdened with extraordinary caseloads.” [2010 Year-End  Report on the Federal Judiciary, <a href="http://www.supremecourt.gov/publicinfo/year-end/2010year-endreport.pdf">12/31/10</a>]</p>
<p><strong>Career Federal Prosecutors: Courts “Cannot Function Effectively” With Judicial Vacancies.</strong>The National Association of Assistant United States Attorneys, a group of  career Federal prosecutors, wrote to Senate leaders in December 2010 saying that, &#8220;Our federal courts cannot function effectively when judicial vacancies restrain the ability to render swift  and sure justice.&#8221; [Sen. <p><strong>U.S. Attorney General: “Men And Women Who Need Their Day In Court Must Stand In Longer And Longer Lines.”</strong>U.S. Attorney General Eric Holder wrote in 2010, “Last  year, 259,000 civil cases and 75,000 criminal cases were filed in the federal courts, enough to tax the abilities of the judiciary even when it is fully staffed. But today there are 103 judicial  vacancies &#8212; nearly one in eight seats on the bench. Men and women who need their day in court must stand in longer and longer lines.  The problem is about to get worse. Because of projected  retirements and other demographic changes, the number of annual new vacancies in the next decade will be 33 percent greater than in the past three decades. If the historic pace of Senate  confirmations continues, one third of the federal judiciary will be vacant by 2020. If we stay on the pace that the Senate has set in the past two years &#8212; the slowest pace of confirmations in  history &#8212; fully half the federal judiciary will be vacant by 2020. <p><strong>American Bar Association: During Judicial Vacancy Crisis, “Civil Proceedings Are Put Off.” </strong>In July 2010, ABA President Carolyn B. Lamm said, “Our courts are  already terribly strained at the federal level because of the caseload and the workload, and when you’re a hundred justices down…that’s a big gap.  We have speedy trial  rules that require them to put criminal cases first.  As a result, all of the civil proceedings are put off and there is a real gap in terms of a significant delay as a result of the  vacancies. <p><strong><em><span style="text-decoration: underline;">Examples of Courts in Crisis, and Their Impact on American Families and Communities</span></em></strong></p>
<p><strong>In Texas, Drug Cases “Continue Piling Up” While Key Posts Remain Vacant.</strong> “Cases in the Western District of Texas, which includes San Antonio and Del Rio, have  been climbing steadily in recent years. In fiscal 2001, some 7,423 cases were filed, but in fiscal 2010 the district recorded 10,495 new case filings. The increase in the Western District, which  stretches along the U.S.-Mexico border all the way to El Paso, where drug trafficking is heavy, has been fueled largely by criminal cases. Last year, 7,491 new criminal cases were filed, compared  with 4,161 in 2001. The district has two vacant federal district court posts, including one in San Antonio and another in El Paso. Overall, Texas has seven federal judicial vacancies…  Meanwhile, new drug cases continue piling up in districts along the border.” [San Antonio Express-News, 1/7/11]</p>
<p><strong>In Colorado, Vacancies Impact Businesses Waiting for Civil Rulings, As Well as Rural and Tribal Communities.</strong> Describing judicial vacancies in Colorado last year, Sen. Mark Udall  said, “Judicial understaffing in Colorado has a real impact on the residents and businesses in our state. As the caseload increases for each judge, more and more time must be devoted to  criminal cases &#8211; this is because of the Constitutional guarantee of a speedy trial. But as time and energy shifts to clearing the criminal docket, the civil docket suffers. It continues to become  increasingly difficult to schedule a trial in Colorado as the backup grows longer.
